I acknowledge and willingly assume the inherent risks associated with renting this kayak or paddleboard and engaging in kayaking or paddleboarding activities. These risks include, but are not limited to, the potential for death, personal injury (such as drowning or bodily harm), and damage to or loss of property. I am aware that participation in kayaking requires good physical health.
Despite the acknowledged hazards, I choose to participate in kayaking or paddleboarding, fully understanding the potential dangers involved. I hereby accept and assume all risks of injury, loss of life, or damage to property that may arise from renting this kayak or paddleboard and engaging in kayaking or paddleboarding activities. I also recognize the inherent risk associated with the use of this equipment and accept complete responsibility for any resulting damage or injury.
In consideration of the kayak or paddleboard rental provided by Joy Tide, LLC ("Joy Tide"), I hereby release and forever discharge Joy Tide, along with its officers, agents, and employees, from any and all liability or claims arising from injury, illness, death, or loss of or damage to property that I may sustain while renting the kayak or paddleboard and participating in kayaking or paddleboarding activities. This release encompasses all forms of liability or claims, including those arising from the negligence of Joy Tide, its officers, agents, or employees.
By signing this Waiver and Release Agreement, it is my explicit intention to absolve Joy Tide and indemnify them against any liability for property loss or damage, personal injury, or loss of life. This waiver applies irrespective of the legal basis, whether it be negligence, breach of contract, breach of warranty, or any other legal theory. I am fully cognizant that, in the event of injury, illness, death, or property damage during my engagement in kayak rental or kayaking activities, I hereby forfeit any right to pursue a claim or file a lawsuit against Joy Tide, its officers, agents, or employees. This relinquishment holds true even in cases where such harm is caused by their negligence.
